GENERAL TERMS & CONDITIONS OF HIRE  

These General Terms and Conditions of Hire shall apply to and form part of any contract for the supply of goods, products and materials and related services by Bebe’s Country Weddings ABN 18 669 337 795 . 

HIRE QUOTATIONS & CONTRACTS   

  1. All quotations are made and accepted subject to these Terms and Conditions unless otherwise expressly agreed by Bebe’s Country Weddings in writing. All previous dealings between Bebe’s Country Weddings and any Customer shall not vary or replace these Conditions or be deemed in any circumstances whatsoever to do so.  
  2. Bebe’s Country Weddings may withdraw, revoke or vary a written quotation at any time prior to the Customer submitting an order which accepts the written quotation. 
  3. The agreement to Hire Goods starts on the date the deposit is received from the Customer.  
  4. By payment of the deposit, it is deemed that this agreement has been read, understood and agreed to.  

PRICE   

  1. The price of Goods will be Bebe’s Country Wedding’s current price at the time of acceptance of the quotation, subject to any contrary agreement (if any) between Bebe’s Country Weddings and the Customer regarding price. 
  2. The price includes all applicable sales tax, and duties as required by law.  
  3. Any items cross hired from other suppliers will be charged at the cost to Bebe’s Country Weddings plus 20%  
  4. The Customer must pay to Bebe’s Country Weddings, in addition to the price, all additional costs incurred by Bebe’s Country Weddings if:  

a. the owner cannot obtain appropriate access to pick up equipment  

b. the equipment is not ready for pick up at the agreed time  

c. the equipment requires cleaning, repairs or replacement  

BONDS   

  1. All rentals are subject to a security bond by bank transfer or PayPal.  
  2. PayPal: Bebe’s Country Weddings will request the Customer’s PayPal account at the start of the hire for an amount of up to $200.00. This amount will then be refunded to the customer’s PayPal account at the completion of the event. 
  3. Bank Transfer: A cash amount of up to $200.00 will be added to your invoice, payable on booking. The bond will be refunded upon return of the items less amounts need to be charged, for items such as damage, rental extension or loss. We will send you an email requesting your bank details after you event.  

PAYMENT  

  1. The Customer shall be liable to pay to Bebe’s Country Weddings full payment of 100% on acceptance of the quotation. The 100% payment secures the quantity and items being hired for the date required.  

CANCELLATION  

  1. 20% of your payment is a booking deposit and is non-refundable to cancellation or change-of-mind. Change of date is subject to availability of stock.  
  2. Cancellation within 14 days of the delivery date will incur a fee of 75% of the total Invoice amount.  
  3. No refund applies if cancellation is within 7 days of the delivery date.

SPECIFICATIONS, MATERIALS & SPECIAL ORDERS  

  1. All descriptions, specifications, illustrations, drawings, data, dimensions and weights provided with the quotation are approximations only. They are intended by Bebe’s Country Weddings to be a general description for information and identification purposes.  
  2. If the Customer is hiring goods by special order, where they are custom built or cross hired, Bebe’s Country Weddings shall not be bound to accept any change in product dimension, materials or finish, a reduction in the quantity ordered or other particulars of the order once Bebe’s Country Weddings has commenced tooling for manufacture or paid deposits to any external supplier.  

DELIVERY, COLLECTION & RISK  

  1. Bebe’s Country Weddings reserves the right to arrange transport by any means at its discretion.  
  2. Delivery and returns will be made during work hours to the location agreed by both parties.  
  3. The Customer must provide Bebe’s Country Weddings with clear delivery instructions prior to the delivery of the equipment. These instructions must include the date, time and name and contact details of the Customer or their representative who will receive and return the equipment. They must be over 18 years of age.  
  4. Bebe’s Country Weddings will deliver the goods within 10m of the delivery point, or in the opinion of the transport contractor, what is safe or prudent to do.  
  5. Bebe’s Country Weddings reserves the right to charge the Customer any costs which they may incur as a result of any delay by the Customer in unloading or collecting the Goods or where unloading or collecting the Goods cannot be affected.  
  6. Dates and times quoted for delivery are estimates only. All efforts will be made to deliver within the specified time period.  

CLEANING & RETURN OF ITEMS  

Bebe’s Country Weddings require that the Customer return the equipment in the same condition that it was provided:  

  1. Furniture must be wiped and free of any food, beverage or external conditions.  
  2. Other items must be returned clean and in its original packaging. If it is not possible to return the items as supplied it is the Customer’s responsibility to inform Bebe’s Country Weddings and in turn Bebe’s Country Weddings will make the necessary arrangements to have the items restored to a suitable standard at the Customer’s expense.  
  3. Linen is to be cleared of any food items and stored dry in the linen bag provided. Plates, cutlery and glassware are all to be rinsed clean and stored dry in original containers with any lids left open. 
  4. In the case of Bebe’s Country Weddings collecting Hired Goods from the venue, all items must be stacked or stored together, close to where collection will take place.  

DAMAGE  

  1. While all care is given to providing quality hire goods, it is the responsibility of the Customer to check all goods immediately upon delivery or collection. If there are any inaccuracies or short supply of goods or any major fault or damage to the goods it is the responsibility of the Customer to notify Bebe’s Country Weddings in writing, within 2 hours of delivery or collection.  
  2. The Customer must take all reasonable steps to protect the items supplied from loss or damage. The Customer is responsible for any loss or damage (irrespective of the cause) and will compensate Bebe’s Country Weddings for the cost to repair or replace the items.  

RETENTION OF TITLE  

  1. The Customer agrees that legal and equitable title to the Goods hired or produced under this agreement is retained by Bebe’s Country Weddings. The Customer is granted a non-exclusive limited-use licence of this Property during the hire period.  
  2. The Customer must take all reasonable steps to protect the items supplied from loss or damage. The Customer is responsible for any loss or damage (irrespective of the cause) and will compensate Bebe’s Country Weddings for the cost to repair or replace the items. 

WARRANTIES, LIABILITIES & INDEMNITIES  

  1. Where applicable, Goods shall be installed in accordance with Bebe’s Country Weddings recommended fixing procedures.  
  2. Goods will be provided with due care and skill and are fit for the purpose for which they are commonly acquired or for a purpose made known to Bebe’s Country Weddings and based on which the goods are supplied.  
  3. Any loss or damage to the Goods caused during the process of manufacture, delivery or installation, these are the responsibility of Bebe’s Country Weddings, will be repaired or replaced by Bebe’s Country Weddings. Any other loss or damage to the Goods are the responsibility of the Customer.  
  4. Bebe’s Country Weddings shall not be liable for any failure to perform its obligations under this agreement if such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, industrial disputes, fire, flood, storm, and national emergencies.

MISCELLANEOUS  

The Law applicable to the agreement between Bebe’s Country Weddings and the Customer is the law of the State or Territory in which the Goods are delivered.
